Prasar Bharati Defies Court Orders

Why do bureaucrats defy Court orders and wait till Contempt’s are issued – This perhaps emanates from   inherent arrogance that most of them are filled with or perhaps test the patience of a snail paced judiciary.

This happened recently again in Prasar Bharati – the hotbed of controversies.  The pettiness with which the previous CEO initiated  internal inquiry on flimsy charges only to dissuade its Addl. DG-South Zone from pursuing his complaint to the Govt. of Karnataka whether CEO Prasar Bharati enjoyed ‘ State Guest ‘  facility and if not then the CEO should not be feasted on public money …. Jawhar Sircar former CEO piqued by this initiated a flimsy inquiry without bothering compliance of procedure and rules against the complainant Officer. This was done even after his resignation was accepted and he had no authority to initiate and pursue such matters.

The CAT Bengaluru stayed all such proceedings in OA 170/1022/2016 as per law and issued notice to Prasar Bharati. Court order dated Dec. 19, 2016 which was received and sent the same day was reportedly ignored by S C Panda the acting CEO then who brazenly continued with inquiry till Dec. 23, 2016.  The Inquiry Officer, a former IAS officer, too did not cease operation and one learns he was even paid Rs. one lakh and half even before the completion of exercise which in any case was reportedly motivated and smacked of vengeance.

Now in the related matter, the Karnataka State Secretariat vide letter DPAR 138 HGG 2016 dated March 20, 2017 adds spice to the matter. Upholding the contention of Dr. Mahesh Joshi, Addl DG- South zone, it confirms that CEO Prasar Bharati does not figure as a State Guest in the Karnataka State Protocol Manual. This vindicates the stand taken by complainant officer.

This exposes how bureaucracy harasses Officers who try to protect misuse of public funds and take umbrage over Court orders by not obeying them. The matter assumes seriousness how the Acting CEO and a coterie of like-minded officers went after an honest Officer merely for pointing out the irregularity. It is strange that a big sum was paid to S P Gaur former IAS as IO without even completing the proceedings that now has to be realized from erring officers . Amongst the coterie of Officers include Sanjeev Jindal former ADG Admn and Ms. Jyoti Singhal- Director Admn who were reportedly over enthusiastic in the matter.  It may be recalled that S P Gaur was earlier reportedly indicted by Liberhan Commission also.

This nevertheless damages standing of Dr. Mahesh Joshi ticked for wrong reasons.
