|
|
Showdown between Political Executive and Bureaucracy continues in Maharashtra.
The showdown between the political executive and the bureaucracy in Maharashtra does not seem to slow down in any way. Now the state legislature has jumped in the fray as Shivsena-BJP led opposition members raised protest over the recent gag orders from Chief Secretary, Ratnakar Gaikwad to the administration asking bureaucrats to ignore official meetings called by Opposition alliance members.

The running feud between the political class and the bureaucracy continues unabated in Maharashtra. In the just concluded monsoon session of the state legislature, it was the turn of the Shivsena-BJP led opposition to crib about the May 12, gag order of Chief Secretary, Ratnakar Gaikwad to bureaucrats and officers to skip official meetings called by opposition elected representatives. The entire opposition was up in arms over the chief secretarys orders demanding that the government withdraw the order.
Leader of Opposition, Eknath Khadse termed the order unjust. While Shivsena’s Suresh Jain and others wanted the government to take strict action against officials refusing to attend the official meetings called by opposition members. The stand-off ended with the government assuring to look into the matter.
On May 12, 2011, Gaikwad had issued a order stirring a hornets nest by virtually gagging the administration and bureaucrats advising them not to attend meetings called by Leaders of Opposition and chairman of State run Corporations who enjoy a ministerial level rank.
In his May 10 circular, Gaikwad had categorically stated that ``Leaders of the Opposition in the Assembly, Leader of the Opposition in the Legislative Council, chiefs of State run Corporations and VIPs who have been granted the status of a minister have no right or jurisdiction on par with a minister to call an official or hold a meeting and issue orders’’. A senior bureaucrat clarified that officials were often confused as to whether or not to obey the orders of the VIPs who had no executive powers hence the circular has been issued to clear the confusion.
It has not been the first time that the politicians in Maharashtra have been at loggerheads with the bureaucracy. Earlier this year on January 13, Chief Minister, Prithviraj Chavan cracked the whip on the bureaucrats post-Adarsh scam to disclose their financial assets.. Despite that, a few days later on January 24, atleast 7 senior bureaucrats had failed to attend the District Planning and Development Committee (DPDC) meeting convened by NCPs guardian minister for Mumbai city, Jayant Patil at Mantralaya. While the Minister and the MLAs and MLCs turned up at the meeting well before 11.00 am, the 7 senior bureaucrats failed to turn up at the meeting leaving several of those present red-faced.
Exasperated at the errant ways of the bureaucracy, a couple of days later Chavan on January 26, set up a 10 member panel of senior bureaucrats from the state in a bid to streamline the administration. However, that attempt came to a naught as some of the bureaucrats opposed the addition of two former bureaucrats V K Jairath and Sanjay Ubale in the panel on the grounds that they were too junior to them to be shown their confidential files.
But things did not end there, on June 2, the entire 25 member Public Accounts Committee (PAC) resigned enmasse over the lack of response from the bureaucrats to their queries and summons. Things have got only worst on July 30, during the recently concluded monsoon session of the state legislature when Peasants and Workers Party (PWP) member, Jayant Patil wanted the government to intervene and stop retired IPS officers from publicly airing their views on security matters. His contention was over statements made by former Mumbai police commissioner, M N Singh (1967 batch) in the aftermath of the triple bomb blasts of 13/7.
If the bureaucracy is anything to go by then the Additional Collectors (state Revenue cadre) are another lot altogether – some of them a law unto themselves. In July last month, Chavan had given promotions to 73 Deputy Collectors to the rank of Additional Collectors and effected their transfers. Out of the 35 sacred cows, barring one the rest of the 34 simply either refused to accept their transfer orders or got them cancelled using their political clout. Much to the dislike of Chavan.

ANNA HAZARE fall-out: State Gazetted Officers Assoc to sensitise its members on eschewing corrupt practices.

One salutary effect that the social activist Anna Hazare’s crusade against corruption is that it has prompted the State Gazetted Officers Association to hold workshop to sensitise the Gazetted Officers against indulging in corrupt practices.
The on-going anti-corruption agitation launched by social activist Anna Hazare may not have affected the administrative machinery of the Central Government much. But in Maharashtra it has affected the state administration so much so that the Maharashtra State Gazetted Officers Association (MSGOA) has decided to organise a workshop to sensitise its 1.10 lakh Class A & Class B officers about how they can stay away from corruption and be more people friendly.
Speaking to Gflies magazine on Saturday, Maharashtra State Gazetted Officers Association (MSGOA) general secretary, G D Kulthe disclosed ``whenever there is talk of corruption it centres around government officers only. Hence we are planning to hold a workshop for our gazetted officers sometime in the third week of September so that they can be sensitised about corruption’’.
Kulthe added ``the workshop will dwell on subjects like work culture, work ethics, how quickly one can do the work of general public, how to maintain cordial relations with the general public and how to learn to maintain their standard of living in the salary they earn’’.
Earlier this year, the government had once again issued general guidelines relating to work for bureaucrats and gazetted officers. The orders related how to interact with ministers, elected representatives and the general public. Close on the heels of that order on January 13, Chief Minister, Prithviraj Chavan had issued orders to bureaucrats and gazetted officers to disclose their financial assets.
The impact of the government orders relating to work ethics has already had its salutary effect on the MSGOA. The association has promptly issued a directive to all the association members asking them not to entertain any out-of-the-way requests or directives from any of the Minister’s. The association has even gone ahead asking the officers and employees to stand up to the pressure tactics and stonewall any attempts to brow-beat them into submission like threats of transfers, suspensions or departmental inquires.

It was only last month that Lok Sabha Speaker, Meira Kumar had led a delegation of parliamentarians from India to the 57th Commonwealth Parliamentary Conference that was held in London between July 21 to July 28. Deputy Speaker of the South African parliament, N C Mfeketo in his presentation on Good Governance had talked about how they had adopted the practice of taking the parliament to the people and holding public hearings to refine legislations.
Much before Team Anna Hazare brought Congress led UPA government to its knees for the second time in a matter of months on the Lokpal bill issue, our Parliamentarians appear to have ignored the warning bells or the writing on the wall as it were. It could not have been more appropriate that one of the workshops or plenary sessions held on July 26 at the just concluded 57th Commonwealth Parliamentary Conference held in London dwelt on `Enhancing Good Governance and Accountability; Improving Standards of Probity and Performance’.
Presenting his paper at the workshop, Deputy Speaker of the South African parliament, N C Mfeketo has argued that holding public hearings while preparing important legislations ``enable a direct formal input by community groups, interest groups, stake holders and individuals into the refining of the legislation’’. According to him ``the concept of good governance and accountability is built upon the foundation and values of citizens participation, rule of law, transparency, responsiveness, equity, effectiveness and efficiency, accountability and strategic vision’’.
Known as the Empire Parliamentary Association when it was founded in 1911, the renamed Commonwealth Parliamentary Association (CPA) in 1954, has been advocating democratic parliaments to enact laws which require legislators and staff to publicly disclose their financial assets and business interest.
Mfeketo talks about how in South Africa under the concept of `Taking Parliament and Legislature to the People’ – formal sittings of the House and some committee meetings are being held in community venues amongst people who would otherwise not be able to travel to the legislature. ``Besides this a Registrar of Members Interests maintains a register of members necessary information and confidential interests relating to their spouses and permanent companions of members’’, adds Mfeketo.
With the country in the grip of a agitation over Lokpal bill, it would have been worthwhile if the 35 member delegation led by Lok Sabha Speaker, Meira Kumar would have taken serious note of what Mfeketo had to say. In his brief intervention in the debate, Deputy Chairman of Maharashtra Legislative Council, Vasant Davkhare spoke about how Maharashtra was the first state in the country to have passed the Right To Information Act, much before the Centre made it into the law of the land in 2005. He also pointed out that Maharashtra enacted the Employment Guarantee Scheme Act in 1970. While the same act was later rechristened by the Centre and passed as National Rural Employment Guarantee Scheme Act (NREGS) in 2005.
Whatever, Mfeketo or Davkhare might have had to say on Good Governance, Accountability and Probity in public life, the concept of Participatory Democracy or Politics of Referendums is yet to take roots even in the mother of all democracies the United Kingdom. Here too despite the 67.9 percent voters giving resounding No verdict to Alternate Vote system (marking multiple choice of candidates in order of preference), the Electoral Reforms Society (ERS) of UK is pressing for yet another referendum titled `Take Back Parliament’ or what is called Right To Recall Elected Representatives if they fail to perform their duties towards their electorate. Already the debate has begun over Participatory Democracy and whether is Parliament still the supreme body which alone has the powers to enact laws that cannot be dictated by outside sources.

‘2011 – A year of political confusion’

The world went through a economic slowdown in 2010 but the GDP in India was around 9 %. The Sensex jumped from 7000 to close at more than 20000. Gold too crossed the Rs. 20,000 mark and silver rose to new heights. All these are indicators of India’s economic stability. The year 2010 is also marked by political downslide where the upholders and mainstays of the political system have been the catalysts of this downfall. The corruption in the organization of the Commonwealth Games has become an example. The stadia were not ready till the last minute. Kalmadi and company are involved in a scam of more than Rs. 76,000 crores. The Telecom Minister A. Raja has caused a loss of 1,72,000 crores to the State exchequer. A person from Switzerland told me that their annual budget is of 39 billion USD and scams in India alone are equal to that amount!
The question then is that what does the horoscope of India depict; in which direction is it taking the people of India, what are the driving factors and what is the hidden agenda of the people who run this Government? We will study and elaborate on what is in store for the country vis a vis its citizens in the coming months.
Horoscope of India:
The birth of Modern India is midnight of 15th August 1947. The lagna is Taurus with Rahu is placed in the lagna; Mars in the 2nd house, five planets are in the 3rd house, namely Sun, Saturn, Venus, Mercury and Moon, Jupiter in the 6th house and Ketu in the 7th house.
• The Nation’s horoscope has “Pravajya rajayoga” signifying that Citizens rise to new heights only after going through the agonies of pain, suffering, criticism, unhappiness and even humiliation
The mahadasa of Sun is in operation for six years from 9/9/2009. Let us throw some light on this mahadasa as it would be in operation till 2015. Sun along with 4 planets are placed in the “upchaya” houses (which are themselves considered powerful) forming a “Pravajya Yog”. This rajayoga can be explained or defined in many ways. Our experience shows that a person (read nation) with “Pravajya rajayoga” rises to new heights only after going through the agonies of pain, suffering, criticism, unhappiness and even humiliation. It is then that the person understands himself or he becomes ‘self enlightened’.
• Citizens of India will regain National pride and Self respect
Slowly but surely the nation and its citizens are becoming conscious and aware as they rise from their slumber. But the nation’s conscience is yet to go through more rigors and trials and tribulations and till this happens the citizens of India will not regain national pride and self respect. We are of the firm opinion that not only will every beleaguered citizen of the country rise up but there will also be a paradigm shift in the National Character of all citizens.
• Traders and business persons indulging in malpractices will also be brought to their knees in the coming months
India is a young nation where more that 50% of the people are below 35 years of age. There is no other nation as young as India. The corrupt, immoral, self centered and selfish business and traders are harming the children of the nation by selling and providing harmful, contaminated and toxic vegetables, fruits, milk and dairy products, sweets, pulses, grain, meats etc. without any shame or guilt. The corrupt and selfish officials, police etc. are giving protection to this mafia and the main leaders and politicians too are either involved in this or are behind all these malpractices. The youth of this nation are capable of taking the country to dizzy heights and are competent enough to challenge any advanced nation. Alas! the corrupt lot of this nation are trying to harm their own generation.
• Enemies of the Nation will be punished in a manner not seen since Independence
We foresee that these wrongdoings, corruption and malpractices will not go on for long and during the ‘mahadasa’ of Sun not only will the citizens of India rise up but these enemies of the nation will also be punished in such a severe manner as has not been seen since independence.
Seeing the situation today one cannot foresee that the nation including the youth would unite to fight for a common cause. In the Nation’s horoscope Sun is placed in the 3rd house or the house of prowess. Sun and Saturn are the natural significators (karka) in the 3rd house. The Moon is weak and has become malefic. Mercury goes along with its bosses and Venus follows suit. Five planets placed together have formed an exceptional ‘rajayoga’ which signifies that no one planet is by itself giving result but are influenced by the “Pravaja rajyoga”.
• The citizens of India will rise up against corruption with a common cause under the ‘mahadasa’ of the Sun
As the Sun ‘mahadasa’ progresses the people of the nation will unite against the corrupt and immoral people and give them a befitting punishment.
• The Government will be immersed in corruption scams and cover up tactics will be used
It is to be noted that in Sun’s ‘mahadasa’ Rahu’s ‘antardasa’ began on 3 November 2010. Shortly after this the 2G scam made headlines and A Raja and company came in the limelight for their role in this scam. Rahu is posited in the lagna and is in ‘Krittika’ or Sun’s ‘nakshatra’. With the start of Rahu’s ‘antardasa’ the Central Government got embroiled in controversies and the winter session of the Lok Sabha was completely disrupted due to the 2G scam.
Earlier in 2010 a few more interesting facts come to light. From 29/6/2010 to 3/11/2010 Mars ‘antardasa’ in Sun’s ‘mahadasa’ was in operation. Mars is significator planet of police, armed forces and sports. Mars is posited in the 2nd house in Aadra nakshatra i.e. Rahu’s nakshatra. During the ‘anatardasa’ of Mars the Commonwealth Games scam made headlines as did the Adarsh housing society scam. Even after all this it does not seem as if the leaders of the country are repentant or sorry nor have any tough steps been taken to prevent any future occurrence of such a scam. Across the government there is complete lack of remorse in fact a cover up operation seems to be in progress. When Kalmadi and company were siphoning off the Commonwealth games money then no CBI enquiry was initiated and only when the money had reached its place then CBI began to investigate. A similar story unfolded in the case of the A Raja corruption charges too. The present situation is that the common citizen of India is in a deep slumber and nothing seems to disturb him. But all this is shortly going to change and this is what the prediction is.
• By end September Government at the Centre will be exposed – August 2011 has already seen an uprising which has shaken the Government at the Centre
The ‘antardasa’ of Rahu in Sun’s mahadasa will be operational till 28 September 2011. At the end of this antardasa the Government at the Centre will be exposed and they will be hard pressed to defend and save themselves. In astrology Rahu is such a planet that misguides a person and also creates an inner fear from which it is extremely hard for the person to emerge. This is the state of affairs for the Government at the Centre. More corruption and scams will emerge in the coming days which will involve many leaders. From this view point March – April will be significant months. The Centre will face defamation and more charges of corruption and things will seem to be getting out of hand. Rahu’s dasa will expose the Government but they will not see a way out. By September Rahu will shake the very foundation of the Government and it will be no wonder if the Government falls.
• End September 2011 to July 2012 will see damage control by the Government
Jupiter’s antardasa will be in operation from 28 September 2011 to 16 July 2012. During this period many plans will be afoot to convey to the public that things are under control and all is well in the Government. But the result of all this will be just the opposite and an intellectual awakening would take place where for the first time in the mahadasa of the Sun, the common citizen will be forced to think about the nation and about the direction which should be taken and what needs to be done. This common cause will be visible through the length and breadth of the country and from here on a wave of change will be initiated.
• An Intellectual Awakening will be seen bring about large scale change
In the coming ‘antardasa’ of Saturn from 16 July 2012 this change will be clearly visible and the common man will show his anger and rebellion to bring about a large scale change in the political scenario which would be in his benefit. From here on the Sun’s ‘mahadasa’ will take a new turn, all citizens will exhibit their prowess and an environment which has not been seen earlier will be formed which will blow the bugle of change.

From 28 September 2011 to 16 July 2012
We would now like to elaborate what will happen in the period 28 September 2011 to 16 July 2012. Sun - Jupiter will operate during this period.
As stated elsewhere in the Nation’s chart Sun is placed in the 3rd house and Jupiter has occupied the 6th house. If Sun rules the pride and self-esteem then Jupiter represents intelligentsia, wisdom, wealth and destiny. When we wrote this article 9 months back at that time Anna Hazare was not in sight but we were very clear that the Nation and the citizens of this country will unite. There has to be a binding figure or cause.
To understand the role of Sun and Jupiter for the next one year we have to understand the current problem from two angles. One obviously from the Government’s point of view and the other from the view point of Anna Hazare and public at large. The placement of Sun in the 3rd house in the basic chart of the country clearly indicates that the Government will act tough in the beginning and try to sail through its agenda on policy matters. The Sun in the 3rd house in the nation’s chart also represents Anna Hazare and the movement run by the people of this country. Jupiter’s placement in the 6th house is not considered good. However being the lord of 8th Jupiter has occupied the 6th house which gives it some additional strength. Technically Jupiter also forms a “Vipreet rajyoga” in this chart. The nation has recently witnessed a tug-of-war between the Government and Anna Hazare. The Government was looking suspicious as well as volatile in the beginning but in the end ceded to all the demands of Anna Hazare as far as the fast goes. Jupiter also represents justice and whenever anything in the name of justice is done, Jupiter stands for it. Anna Hazare and Civil Society want a Jan Lokpal Bill to be not only introduced in the Parliament but subsequently passed by the members of the Parliament.
There are going to hot debates in the Parliament but subsequently the majority of the Members cutting across party lines will want to vote for the Bill due to hidden fear or compulsion; but on certain issues the Bill’s fate will hang till the end of Jupiter’s period i.e. till 16 July 2012. It is certain that the entire campaign will awaken each soul of the country and they will see through the politicians and their agenda.
We will later take up the events for the next 1 year, from 16 July 2012 to 28 June 2013, which will be the determining period and will see a further political awakening in people of 6 years to 80 years.

London calling
|
|
JOCKEYING has started for an important post in the Indian Foreign Service – the Head of Mission in London – which will soon fall vacant. Pavan K Varma – at present Ambassador to Bhutan – is one of the aspirants. He was earlier posted in London as head of the Nehru Centre but was recalled after just a year because of differences with the then High Commissioner, the highly connected Kamlesh Sharma. The latter is now Secretary-General of the Commonwealth. Varma had returned on condition that he be made the Director General of the Indian Council for Cultural Relations. During his tenure in the ICCR, he had excellent relations with its President, Karan Singh. This should serve him in good stead now. Another name making the rounds was that of the former Election Commissioner, Navin Chawla. But his avowal that he is not interested has put paid to his chances.
Meanwhile, the post of Mission Head in Paris is also being vacated – by the new Foreign Secretary. Two candidates were angling for it. One was Sujata Singh, High Commissioner in Australia. The other was Rakesh Sood, Ambassador to Nepal. Insiders felt Sujata had an edge with her reputation for quiet competence while Sood is said to have further complicated our generally troubled relations with our neighbour. But he won in the end.

Rudy desires elimination of Air India – supports reinstatement of two discredited Directors !!
|
|
One for now sure knows the growing ire of BJP spokesperson and former Union Minister of Civil Aviation, Rajiv Pratap Rudy’s against the Air India Chairman & Managing Director, Arvind Jadhav.
Rudy is clearly upset because Jadhav, while following government norms and procedure, has finally shown the door to the company’s two most controversial – Anup Srivastava, Director Personnel, and Amod Sharma, Director SBU.
This more than evident from Rudy’s letter to the Prime Minister wherein he states: “How is that Arvind Jadhav, who got himself appointed as the CMD, had the competency to sack/dismiss two other senior-most directors Amodh Sharma, Director SBU (AI) and Anup Srivastva, Director HR (IA) who were ACC appointees, who had appeared with him in the same Search Committee for interview for appointment of CMD (AI) in 2008.”
While the immediate provocation of Rudy’s ire against Jadhav, who has been CMD since May 2009, is the ouster of the two controversial directors, he has been against Jadhav also because he sees the CMD as a major hurdle against his efforts to eliminate Air India – a move of privatisation that he initiated as Minister in Civil Aviation.
It is reported that Rudy was also the mentor Air India pilots who recently went on strike. He instigated Air India pilots to bring the national carrier to a halt – a misadventure which not only cost the ailing company over Rs 250 crore loss but also led to the striking pilots finally apologising to the High Court for their ill-advised decision to go on strike.
The fact is that Amodh and Anup had completed their tenure as Director, after individually getting a three-month extension each, and were relieved by the Government. Both of them had not applied for ‘lien’ which would have enabled them to join their substantive post. Now without any portfolio, both have recruited people like Rudy to sneak back into Air India.
It would be pertinent to mention here that Anup is being investigated by CBI and CVC; he was hauled up for sanctioning illegal housing loans and encashments; has a disproportionate assets case; instigating strikes and industrial unrest; and for forging documents. Similar is the case of Amodh who has nearly a dozen investigations being conducted against him by the CVC, including massive misuse of position for upgrading tickets and waiver of Excess Baggage Charges.

|
AIR India Chairman and Managing Director Arvind Jadhav knew he had his plate full when he took over the task of turning around the national carrier. But little did he realize that he would face a vicious attack from his immediate predecessor, EK Bharat Bhushan – an Additional Secretary who was removed as CMD within weeks of joining.
Now Air India’s Financial Adviser, nominated by the Ministry of Civil Aviation, Bhushan is working relentlessly at his single-point agenda of destabilizing Jadhav. Every Air India paper that goes to the Ministry is put into a spin – so much so that inertia now dogs the airlines and in two years it has not been able to put its turnaround plan on track. Worse, Bhushan’s mala fide intentions were bolstered by the then Secretary, Madhavan Nair.
The ouster from Air India of Praful Patel and Nair’s retirement did not help as Bhushan became the director general of the Directorate General of Civil Aviation. His main preoccupation was briefing the media against the airlines’ minor lapses such as having one crew member less on a flight, pilots flying an hour more than allowed and so on. This bid to portray the airlines as unsafe was aimed at getting Jadhav. Lately, he has intensified his attack as he hopes to replace Jadhav with the latter facing criticism for Air India’s increasing losses.

2G Scam: Murli Deora's Team Cites Clerical Error in an attempt to save the Ruias!
|
|
Inspite of Supreme Courts firm push to the CBI to ‘do its job’, it looks like that the Essar – Loop 2G Scam investigations are in for a rough ride.
Caught on the back foot, over its 2 contrary stands taken regarding Essar Group's holding in Loop Telecom, Corporate Affairs Minister Murli Deora has asserted that the holding of the Ruias was less than 10 per cent in the Loop Telecom and the Ministry stood by its reports.
This clarification has come in response to the CBI claims that the Essar Group had over 10 per cent stake in the Loop Telecom at the time of award of the 2G spectrum licence.
It was alleged that Essar used Loop as a front company to corner spectrum in violation of the guidelines.
Deora admitted that there was a communication gap between the Ministry and the CBI and the matter has been sorted out.
Though Deora did not mention this, a senior MCA official provided a rather hilarious explanation for the discrepancy in the ministry’s report prepared in 2009 stating that Essar group had a 9.9% stake in Loop while a recent April note revised this to 2.15%. The official said that the MCA had made a “clerical error” in 2009 when it had reported that Essar held 9.9% stake in Loop indirectly. The “error” was, however, corrected in 2011 when the regional director of Mumbai’s registrar of companies (RoC) — Western region —had found Essar to hold just 2.15% stake in Loop Telecom, far below the 10% cap.
If CBI buys this ridiculous explanation, another infamous “Clean Chit” is on its way in the 2G scam investigations, and another big corporate will get away!
On 6th July, 2011, the CBI in the Supreme Court complained against the Ministry of Corporate Affairs (MCA) for “pre-empting” investigation in the 2G spectrum scam by passing a verdict that there was no link between Loop and Essar even before the CBI had completed its own probe in the issue. The MCA, headed by Murli Deora, who recently offered to resign, had ruled that Loop was not an associate of Essar.
Ignoring the fact that Loop is owned by Khaitan and her husband IS Khaitan, the MCA had provided a clean chit to the two companies, stating that both have no link with each other. Kiran is sister of Ruia brothers —Shashi, Prashant and Ravi —owners of Essar group. The MCA move was obviously an attempt to save the Ruias from the 2G Scam investigations.
In its latest status report to the Supreme Court, the CBI submitted evidences to the effect that the shareholding pattern of Loop Telecom changed just two days prior to the date of award of 21 UAS licences in 2008.
CBI counsel KK Venugopal said, “They (MCA) are handing over documents to television media and photographs of it are appearing in print that there is no connection between the two companies. It is an attempt to pre-empt. This should not be permitted when the matter is under investigation.”
Referring to the MCA ruling, the CBI asked the court to restrain anybody from “pre-empting” a matter under investigation. The CBI registered its strong reservation to the recent disclosure by the MCA claiming that Essar did not have any technical link with Loop Telecom —one of the spectrum beneficiaries being probed in the 2G spectrum scam.
The CBI even frowned upon certain legal opinions on which MCA had relied and passed them over to the agency for consideration. The Bench of Justices GS Singhvi and AK Ganguly said, “CBI or any other investigating agency is not going to be influenced by the opinion of anybody.”
The court took note of MCA’s earlier report that was quite contrary to the later one, and said, “One of the Ministries has done a somersault.”
The SC asked the agency to complete probe at the earliest. It said, “An attempt may suddenly be made to sidetrack the investigation. If there is a delay, they will cover up everything.”
What prompted the investigating agency to react sharply to MCA’s recent disclosure was the wealth of material it collected against Loop. With the contents of its status report revealing details of the third chargesheet likely to be filed before the 2G special court before August 31, Venugopal hinted that there was sufficient evidence to indicate Essar group was the controlling company of Loop.
The telecom licences were allotted first in the name of a shipping company —Shipping S India Dotcom ---earlier owned by Ruia’s. This company later changed the name to Loop Telecom.
While Loop had claimed that investment in the company was done through non-convertible debentures that could not be treated as equity investment, the agency discovered there were “significant links” of Essar with the licensee company under probe. “The shareholding pattern reveals that 85.75 per cent shares in the company are held by the Essar group director’s sister and her husband through the original company.”
Loop, which applied for telecom licence in the name of Shipping S India Limited, had capital worth of just Rs one lakh. “Till two days before the grant of licenses it (Loop) was wholly owned by the group company, but the shareholding pattern of the company transferred just two days before the licenses were given.”
In addition, papers linked to Loop suggested that employees of the company were members in the Board of the group company.
Further, documents seized during the raid at Loop offices gave evidence to CBI on how the Essar group provided Rs 700 crore as advance to licensee for grant of licence. “The short-term loan from State Bank of India was issued to Loop as part of the group company,” CBI said. This finding provoked the Bench to say, “Few months ago an attempt was made to show the banks are not connected. Slowly we find even the banks are involved.”
The CBI informed the court that the money trail with regard to other licensee companies was in progress and the probe would take three months to complete. It revealed that in response to the Letter Rogatories, the CBI teams had visited seven countries and met with significant success in trailing the 2G money to Mauritius, Cyprus, Isle of Mann and British Virgin Islands.

HINDI is the official language of India and, in the Atal Behari Vajpayee administration, Cabinet ministers and the bureaucracy vied with one another to show off their mastery of the language. Some even ventured into Hindi poetry but perhaps the less said about that the better. In the UPA administration, the situation is quite the opposite. When Baba Ramdev aide Acharya Balkrishna’s handwritten note in Hindi was presented on June 4 to the Cabinet Committee on Political Affairs (CCPA), none of the members could read it. Prime Minister Manmohan Singh can read Urdu but not Hindi. Finance Minister Pranab Mukherjee can read Bengali but not Hindi. The question of Home Minister P Chidambaram being able to read Hindi just does not arise. Renewable Energy Minister Farooq Abdullah might have been able to read it but he never attends CCPA meetings. Finally, a bureaucrat was summoned to read the note.
Mukherjee reportedly asked Chidambaram to tell the Department of Official Language under him to organize a crash course in Hindi for him and others in his Ministry. Pranabbabu joked that they were like the five blind men describing an elephant by touching various parts of its anatomy.

HC declines PIL praying for staying Baijal’s transfer
|
|
The Bombay High Court has turned down a Public Interest Litigation (PIL) of a Nashik based NGO seeking stay on transfer of Superintendent of Police, Nashik Anti Corruption Bureau, Harish Baijal (1992 batch). Baijal’s transfer has sparked off a bitter war of words with Internet community posting messages of support on Facebook wall. On May 30 this year Baijal was transferred by the government to Thane as Deputy Commissioner, Thane city.
However, Baijal moved the Maharashtra Administrative Tribunal (MAT) on grounds that he had been unceremoniously transferred from Nashik to Thane within two years before the completion of the mandatory three year stint in one posting. Twice the MAT headed by former Maharashtra additional chief secretary (Home), A P Sinha stayed the government order. The government moved the HC which stayed the MAT order. The government in its plea argued that there were specific complaints made against Baijal hence the transfer was necessitated.

The buzz is that Divya Salaskar, daughter of senior police inspector, Vijay Salaskar who was martyred in the 26/11 Mumbai terror attack has been appointed as Assistant Commissioner, Sales Tax, Mumbai. However, the appointment came only after she called on union Home minister, P Chidambaram when the latter visited Mumbai in the wake of 13/7 terror attacks. Divya Salaskar did admit to having received the letter from the state government informing her of her appointment.
She added that there had been quite a long procedural deadlock over giving her a government job. It was only after the intervention of the union Home minister that things began moving fast in the state government machinery. Divya is now bracing herself for her new posting as she is busy completing the necessary formalities and paperwork.

Maharashtra Govt has just one official English translator in service!

In an era of globalization and liberalization State Governments are engaged in a rat race to attract more foreign investment to their state. The otherwise pro-liberal Maharashtra Government appears to behave like an Ostrich, burying its head in sand when it comes adopting some basic governance necessities like having mastery over universal languages of communication like English. Has too much emphasis on Marathi ethos, culture, language and politics got to do with it ?
MUMBAI:
The Shivsena-BJP ruled Brihanmumbai Municipal Corporation (BMC) had in 2008 tried to enforce a dictate on all shopkeepers in Mumbai to have their name plates in Marathi. The cause was later championed by Maharashtra Navnirman Sena (MNS) chief Raj Thackeray but the matter was later dragged to the court. Flipside of this overzealous espousing of Marathi cause is now being felt in the Information and Public Relations Department of the Government of Maharashtra that has just one fulltime officer who can translate Marathi documents into English.
Sources in the department revealed to indianbuzz that around 20 odd young sub-editors cum reporters were recruited in the recent past as Department Liaison Officers (DLOs). ``All of them were recruited on the conditions that they would be doing English translations as well. But soon after they join they somehow manage to pass the buck on with excuses galore. So the situation is back to square one’’, said an official from the office of the Directorate General of Information and Public Relations (DGIPR).
Currently there is only one senior non-Maharashtrian lady officer who handles all the translation work of all the government department’s in Mantralaya. Speaking on condition of anonymity the official added ``the lady officer in question come early in the morning and leaves work by late afternoon. She is mostly saddled with translation work of court matter and other works. Essentially she was supposed to do translation work of government press handouts in Marathi. While the rest of the DLOs file their reports late by evening and thus the lady officer has no time to translate them into English. As a result most of the time there are no government press handouts in English sent to English media houses’’.
The attitude of the Mantralaya administration towards English translation is typified by this example. ``Recently a staffer from the office of a Principal Secretary came down to our office as his boss wanted translation of the Marathi instructions on the backside of an Identity Card. Those department’s who have South Indian or Anglo-Indian staffers with them, for them it is fine’’, added the official.
Worst of it all is the administrations attitude towards the governments English monthly magazine `Maharashtra Ahead’. The official added ``more than the officials helping us out in bringing out this magazine, from day one the query to us is this the last issue ?’’

Gas let off over Chandra
|
|
SOME heartening news from the heart of the bureaucracy. There are still many bureaucrats who work for the nation’s interest, make sacrifices and take a stand when it is called for. Apurva Chandra, an IAS officer of the 1988 batch from the Maharashtra cadre, looks after the Gas Division in the Ministry of Petroleum. As a remedy for the crises in the electricity and fertilizer sectors, he suggested to Minister for Petroleum S Jaipal Reddy that the KG Basin gas be allotted to these sectors rather than the private producer supplying the gas to private users.
This means that the KG Basin gas producer will have to sell it on subsidy and there will be no profit. Chandra made the suggestion in a file noting and it created a furore in the Ministry. Chandra may have to pay a heavy price for his efforts to further the nation’s interest by losing his prestigious and coveted post in the Ministry of Petroleum. Last heard he maybe on his way to the DoPT, since the minister is not able to find a way out to sideline him. APURVA CHANDRA (1988 IAS MH) Joint Secretary (Marketing) in Petroleum Ministry will now be Joint Secretary in MSME.

War of the wives in Beijing

THE Indian School in Beijing will soon be shut down, and probably has been already as we go to press. And, hopefully, this will end the war of the wives of two of the embassy’s senior officials. Or will another round begin on some other issue? The school was started at the height of China’s Cultural Revolution. Since the social upheaval affected standards of education, the Indian Embassy, which was especially targeted during those days, decided to start its own school to benefit its officials and staff. Over the years, the school acquired a reputation among Beijing’s expat community, especially those sections who could not afford the ones run by the US and British embassies. The Indian School’s forte was affordable quality education matching international standards. In recent years, it had also become the school of choice for Beijing’s expanding Indian business community. However, embassy officials subscribed to the view that, since the Cultural Revolution ended quite some time ago, the school had lost its utility. And the war of the wives was another headache.

THE UPA-II government might be on the fast track, especially regarding economic development, but its Secretaries are a harried lot. Ministers direct them to implement the projects but, down the line, Joint Secretaries feel the pinch in the deals. The projects are worth thousands of crores of rupees and harbour the vested interests of MNCs or large business houses. Even the PSU appointments are creating a stir in the government as they are the handiwork of big business. With the surfacing of the 2G and similar scams, that have sent Secretaries and other officials behind bars, Joint Secretary-level officers are afraid to shoulder the responsibility of clearing files. The Secretaries came up with a solution: take away departments from the nonperforming Joint Secretaries and allot them to much junior Joint Secretaries. But this too has not yielded the desired results. Many Secretaries and Joint Secretaries are not in tune with the scope, design and technicalities of the deals.

Home Minister clears RIL's sale stake in oil & gas blocks to BP
|

The buzz is that the Home Ministry has given unconditional approval for UK's BP to buy a 30% stake in Reliance Industries' oil and gas blocks, including the showcase KG-D6 gas fields, for USD 7.2 billion.
The Ministry of Home Affairs wrote a one-page letter to the Petroleum Ministry on 1st June 2011 giving security clearance and a no-objection certificate for BP buying a 30% stake in 23 oil and gas blocks of Reliance in India's largest foreign direct investment, a top Oil Ministry official said.
While the NOC to the Reliance-BP deal is unconditional, the Home Ministry asked if Reliance could not have offered the stake to state-owned gas utility GAIL India or any other PSU.
After the NOC from the Home Ministry, the Petroleum Ministry will accord in-principle approval to the transaction, after which amendments to the production Sharing Contracts (PSCs) .Reliance will retain operatorship of all 23 blocks.
Stating that GAIL, ONGC and Oil India had to foot Rs 25,200 crore out of the Rs 75,600 crore railers lost on selling fuel below cost, it said, "Oil PSUs' share in the marketing of natural gas would take a big hit if the BP-Reliance duo enters the segment in a big way, which it is expected to do so."
"30% stake in Reliance's gas and oil assets could have been offered to GAIL or any other PSU which could have raised the USD 7.2 billion as a consortium," it added.
Also, the ministry said it needs to be "ascertained whether the New Exploration Licensing Policy (NELP) agreement/contract under which Reliance bought the oil wells had a provision for the sale of assets and whether the Reliance-BP deal would enable BP to sell/transport gas outside the country."
The Oil Ministry official said NELP provides for farm-outs or stake sales and Reliance's agreement with BP was in perfect conformity with that.
The USD 7.2 billion Reliance-BP deal is seen as the biggest FDI into India. A much larger proposed transaction -- Posco's USD 12 billion investments announced years ago for a steel plant in Orissa -- is yet to take off.
Reliance is the operator in all the 23 blocks, while Canadian Niko Resources and UK's Hardy Oil have minority 10% interest in a few. After the deal, Reliance' holding in the blocks will come down to 60-70%. Nineteen out of 23 blocks lie off the East Coast, while two blocks are onland, in Assam and Gujarat.

The buzz is that Central Vigilance Commission while responding to Vigilance Complaint of Corruption & Irregularities filed by RTI Activist Gopal Prasad dated 23/3/11 has ordered a Serious Enquiry against the Officials of Ministry of MSME. On the directions of CVC a High Level Enquiry Committee has been formed under the Chairmanship of Secretary (MSME) Shri Uday Kumar Verma. The saga of Air India : Sour Grapes
|
|
The plight of Air India is no secret. Financial bankruptcy stares it
and its owner – the Government of India – seems to be in no hurry to
rectify the situation. More than operations and performance reasons,
Air India is saddled with a back-breaking interest burden. The Company
pays a daily interest of over Rs.9.2 crore on loans for working
capital as well as for buying aircrafts. There is no money to pay
salaries, vendors, suppliers or buy sufficient fuel. The company is on
a ventilator and gasping for breath ever since the misguided pilot
went on flash strike last month.
But instead of analysing the real reason for Air India’s downslide,
some self-appointed messiahs have resorted to blame game – a game,
again not a secret, which Air Indian excel in and are responsible for
the huge ongoing HR mess. A majority of the employees are also
responsible for the company’s present plight as all that they have
done all these years is to fleece/ rape the company.
One such employee / messiah is a former company executive director who
is venting his ire against the company’s present management singularly
because his attempts to get an extension as a consultant on a hefty
salary were rejected. His immoral and unethical ways continue even
now. These days he fleeces his company by availing free passage to
travel only to destinations where he competes in abusing the company
and the government.
He has little credentials and was never involved in any key
operational area of Business during his long stay in the company. His
only brief stint in a department where he was expected to perform saw
his ouster by all others in the department due to his high-handed and
corrupt manner of functioning. Corruption-inspired, this officer was
issued “an administrative warning” in 2004 after the then management
found him “not following procedures for contracts given in his role as
inflight department incharge”.
This particular officer was often disgraced by Air India’s various
chairmen for being incompetent and a complete failure. He once even
quit to join the private sector, but was not taken for being a loud
mouth. On another occasion, he put in his papers after being charged
for sexual harassment. But every time he managed to survive due to
political interference and support from his political masters.
Today, most Air Indians wonder why the government and the company is
taking no action against this errant officer who has caused immense
loss to the company during his days as an employee and now as an
outsider. The irony is that this officer continues to be on a Ministry
of Civil Aviation committee even though he blames the Government and
the Ministers for killing Air India.

A petroleum Secretary has been transferred for the first time in 13 years. The last one to be transferred was TS Vijayaraghavan in 1998. Since then, each incumbent of the post has held it until retirement. Now, in a sudden move, S Sundareshan, 1976-batch IAS officer from Kerala, has been replaced as Petroleum Secretary by Girish Chandra Chaturvedi. Sundareshan was dealing with several critical issues: the $9.6 billion Cairn-Vedanta deal is awaiting clearance, as is BP’s acquisition of 30% stake in Reliance Industries’ (RIL) 23 oil and gas blocks. Then there is the deadlock between the oil and gas regulator and RIL over production at the Krishna-Godavari basin’s D6 well. If insiders are to be believed, Sundareshan was one of the biggest hurdles in the clearance of the Cairn-Vedanta deal. He seemed not to understand that, if his boss, Murli Deora, could be shifted, so could he.
